Acceptance of Terms

Welcome to Everlog. By downloading, installing, or using the Everlog app ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you don't agree, please don't use the App.

These Terms form a binding agreement between you and the individual developer behind Everlog ("we", "us", "I"). This is a solo indie project — not a corporation — so these terms are written to be clear and fair, not to bury you in legal language.

We may update these Terms from time to time. If we make material changes, we'll update the date at the top and post a notice inside the App. Continuing to use Everlog after changes take effect means you accept the updated Terms.

Description of Service

Everlog is a local-first life logging app for iOS. It lets you capture daily events, habits, and moments using natural language or manual entry. The app analyzes your history to surface patterns and insights over time.

Local-first means your data lives on your device. Everlog is not a cloud service. Your journal entries, categories, and settings are stored in a SQLite database on your iPhone. We do not host your personal data on our servers.

The app works fully offline. Network connectivity is only used for optional AI-powered text parsing and, for Premium subscribers, iCloud backup.

User Accounts

Everlog does not require you to create an account. There is no username, password, or email address associated with your use of the App.

Your identity within the app is based on your device. On first launch, a random anonymous identifier is generated for your device. This is used only to enforce daily AI usage limits. It is not tied to your Apple ID or any personal information.

What this means for you: If you switch devices, you start fresh. There is no account to transfer or recover. This is a deliberate privacy trade-off — we know where your data is at all times: on your device.

Subscriptions & Billing

Everlog offers a free tier with limited AI usage, and a Premium subscription that unlocks higher AI limits, insights, and iCloud backup.

All billing is handled by Apple through the App Store. We never see, store, or process your payment information. Prices are in USD and may vary by region based on Apple's pricing tiers.

No refunds from us directly. For refund requests, contact Apple Support — they manage all App Store transactions. We have no ability to issue refunds ourselves.

Apple's required disclosure: Payment will be charged to your Apple ID account at the confirmation of purchase. Subscription automatically renews unless it is canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscriptions by going to your account settings in the App Store after purchase.

AI Data Processing

When you use AI-powered log entry parsing, the text you type or dictate is sent to Anthropic's Claude API to be interpreted into structured data (category, people, places, sentiment, time). This is the only time your content leaves your device.

By using the AI parsing feature, you acknowledge that your input text will be transmitted to a third-party API (Anthropic) for processing. If you are not comfortable with this, use manual entry mode — it is always available and always free.

Data & Privacy

Your journal data is yours. We do not collect, sell, or share your personal content. All entries are stored locally on your device.

For Premium subscribers, iCloud backup is an optional feature that stores an encrypted copy of your local database in your personal iCloud account — infrastructure we do not control or have access to.

Intellectual Property

The Everlog app — including its design, code, branding, icons, and original content — is owned by the developer and protected by applicable copyright and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App on your personal iOS devices solely for your own personal, non-commercial use. You may not copy, modify, reverse-engineer, distribute, or create derivative works of the App.

Your journal entries and personal data remain entirely yours. We claim no ownership or license over anything you write or log inside the app.

Disclaimer of Warranties

Everlog is provided "as is" and "as available", without warranty of any kind — express, implied, or statutory.

This is an indie app built and maintained by one person. While I care deeply about quality and reliability, I cannot guarantee that the App will be error-free, uninterrupted, or perfectly accurate at all times. There may be bugs. Features may break. Updates may introduce regressions.

To the extent permitted by law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Your use of the App is at your own risk.

Limitation of Liability

To the fullest extent permitted by applicable law, the developer of Everlog shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of data, service interruptions, or inaccuracies in AI-generated output.

If, despite the above, we are found liable for any claim arising out of your use of the App, our total aggregate liability shall not exceed the total amount you paid us in the 12 months immediately preceding the event giving rise to the claim. If you have not made any payments (i.e., you are on the free tier), our liability is zero.

In plain terms: If something goes wrong — an AI parse gives you a wrong result, the app crashes and you lose unsaved data, or a service goes offline — we are not liable for damages beyond what you've paid us. This is a standard protection for any software product, and especially important for a solo-developer app.

Data Loss Disclaimer

Please read this section carefully. It is the most important practical risk of using a local-first app.

Because Everlog stores all data on your device, there are several scenarios where your data can be lost permanently:

We cannot recover your data. We never had it. This is not a limitation we will fix someday — it is an architectural decision made in service of your privacy. The trade-off is yours to manage.

What we recommend: Enable iCloud backup in Everlog's settings (Premium feature). This is the only way to restore your data if something goes wrong with your device. We take no responsibility for data loss resulting from failure to back up.

Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the App or its features at any time, with or without notice. This includes changing pricing, adding or removing features, or shutting down services.

Because your data is local, even if the app or our backend services go offline, your journal entries remain on your device. Manual entry and local browsing will always work as long as the app is installed and your device operates normally.

If we ever decide to shut down Everlog entirely, we will provide reasonable advance notice and guidance on how to export your data.

Termination

You may stop using Everlog at any time by deleting the App. Deleting the App removes your local data permanently (unless you have an iCloud backup).

We reserve the right to restrict or terminate your access to our backend services (AI parsing, backup sync) if we determine, in our reasonable judgment, that your use violates these Terms or is abusive or harmful — for example, attempting to circumvent usage limits or exploit our infrastructure.

Termination of access to backend services does not affect your ability to use the App in offline mode for manual entry and local data browsing.

Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of India. If you are located outside India, you agree to this jurisdiction and waive any objection to it.

Changes to These Terms

We may update these Terms from time to time. When we do, we'll update the effective date at the top of this page. For significant changes, we'll also post a notice inside the App.

Continued use of Everlog after updated Terms are posted constitutes your acceptance of those changes. If you disagree with any change, you can stop using the App and delete it from your device.

We will never retroactively change terms in a way that removes rights you already had without giving you clear notice and time to act.
